1. Eligibility and acceptance
You may use PEAK only if you can legally enter into these Terms under the laws that apply to you. If you use PEAK on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. What PEAK provides
PEAK is a focus and commitment tool for iPhone. Features may include focus timers, Screen Time-based distraction shielding, Strict Mode, presets, routines, progress history, local notifications, and subscription-gated access.
Features may change, be added, be removed, or be unavailable on certain devices, iOS versions, regions, or account configurations. PEAK may require Apple permissions or entitlements to provide some functionality.
3. Subscriptions and purchases
Some or all PEAK functionality may require a paid subscription. The price, billing period, trial terms, and other purchase details are shown before you confirm a purchase.
iOS subscriptions are billed through your Apple ID and the App Store. Unless the offer says otherwise, subscriptions may renew automatically until cancelled. You can manage or cancel App Store subscriptions through your Apple account settings. Cancellation generally takes effect at the end of the then-current paid period.
Refund eligibility and payment disputes for App Store purchases are subject to Apple's rules and processes. PEAK may use RevenueCat to determine whether your subscription entitlement is active and Superwall to present subscription offers.
4. Screen Time, blocking, and Strict Mode limitations
PEAK relies on supported Apple frameworks and permissions for distraction shielding. Blocking behavior can be affected by iOS, device settings, permission state, system restrictions, software updates, and Apple framework behavior.
PEAK does not promise that a device can be made impossible to exit, unlock, reconfigure, or regain control of. Strict Mode adds deliberate friction inside PEAK; it is not a security mechanism and does not override iOS or system-level controls.
You remain responsible for how you configure and use PEAK. Do not rely on PEAK as a safety-critical, medical, emergency, access-control, parental-control, or cybersecurity system.
5. Acceptable use
You agree not to misuse PEAK or the website. This includes attempting to interfere with service operation, bypass access controls for unlawful purposes, probe or attack infrastructure, distribute malicious code through PEAK-controlled channels, impersonate others, or use the service in violation of applicable law.
6. Ownership and license
PEAK, including its software, visual design, branding, text, and other original materials, is owned by its developer or applicable licensors and is protected by intellectual-property laws.
Subject to these Terms and applicable App Store terms, you receive a limited, personal, non-exclusive, non-transferable, revocable license to use PEAK for its intended purpose on devices you own or control.
7. Disclaimers
To the maximum extent permitted by law, PEAK is provided on an “as is” and “as available” basis. No guarantee is made that PEAK will always be uninterrupted, error-free, compatible with every device configuration, or effective for every user's productivity goals.
Focus statistics, streaks, timers, and progress views are productivity information, not professional, medical, financial, or legal advice.
8. Limitation of liability
To the maximum extent permitted by applicable law, PEAK's developer will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost opportunities, or business interruption arising from or related to your use of PEAK.
Where liability cannot legally be excluded, it will be limited to the minimum amount permitted by applicable law. Nothing in these Terms excludes rights or remedies that cannot lawfully be waived.
9. Suspension and termination
You may stop using PEAK at any time. Access may be suspended or terminated if necessary to comply with law, protect PEAK or other users, address misuse, or discontinue the service. Subscription cancellation and deletion of the app are separate actions.
10. Changes to PEAK or these Terms
PEAK and these Terms may be updated from time to time. When these Terms change materially, the effective date will be updated and additional notice may be provided where appropriate. Continued use after updated Terms become effective constitutes acceptance to the extent permitted by law.
